CBI Spl Court extends custody of Karti

A Bench of Justice S. Muralidhar and I.S. Mehta said the ED will not arrest Mr. Karti Chidambaram till the next hearing in the High Court, if the special court grants him bail in the corruption case registered by the CBI.

Karti has been granted the Interim Protection from the Delhi High court after being denied yesterday.

The Court said that the ED can not arrest the businessman until the next hearing in the case. He has repeatedly said he was being framed by the agencies at the instance of the government.

The bench, which also comprised Justices A M Khanwilkar and D Y Chandrachud, asked Mehta as "What if Karti is arrested by ED as soon as he is released by CBI from its custody?" Bhaskaraman was arrested by the Enforcement Directorate on February 16 and has been sent to judicial custody till March 22. The order was passed by the special CBI court in Delhi.

According to ANI, the CBI filed another application seeking the court's permission to produce Indrani and Peter Mukerjea for confronting them will all accused in the case.

Additional Solicitor General Tushar Mehta vehemently opposed the contention of senior advocate Kapil Sibal, appearing for Karti, that he should be allowed to withdraw the writ petition and approach the high court for the interim relief. The fresh recovery has been made following Karti's questioning by the CBI. The investigative agency had sought to remand him to 15-day custody for further questioning, which would include confronting him with evidence. This new extension is because the organization has found new material that further incriminates Kart in the case.

Karti was arrested from Chennai by the CBI and later sent to the probe agency's custody. However, on the intervening night of March 6 and March 7, he was shifted to a cell where guards were also sleeping the same night. "The CBI has to justify remand every day and every minute", Singhvi said on behalf of Karti. As a result, the accused's blood pressure shot up and he faced medical problems, he said.

Karti argued about the quality of the CBI probe and said at this rate they would take years to complete the questioning.

The court also directed the investigating officer to get Karti medically examined as per the rules every 24 hours during the custody.

Former Finance Minister P Chidambaram's son Karti got interim protection from Delhi High Court from arrest by Enforcement Directorate till March 20, but the trial court extended his CBI custody by three more days in the INX Media bribery case.
