Dem Group Files Kavanaugh Ethics Complaints, Sent to Circuit Court

Garland had been nominated to the Supreme Court by President Barack Obama, but Senate Republicans never acted on the nomination. The complaints deal with statements Kavanaugh made during his confirmation hearings and were initially filed with the D.C. Circuit, where Kavanaugh served for 12 years before joining the high court.

Roberts' letter was sent to Judge Timothy Tymkovich, the 10th Circuit's chief judge.

Although the complaints were originally lodged with the US Court of Appeals for the District of Columbia Circuit, Kavanaugh's former court, the circuit executive of that court asked Roberts to transfer the matters to another circuit out of a "concern that local disposition may weaken public confidence in the process". They both stem from a hearing during the confirmation process to address sexual assault allegations against Kavanaugh. He said the 10th Circuit would probably close the case because it is outside of its jurisdiction now that Kavanaugh is a Supreme Court justice.

The Washington Post spoke with University of Pittsburgh law professor Arthur Hellman about the likely next step.

"Say it loud, and say it clear: Kavanaugh's not welcome here!" they chanted, dressed in long red robes and white hats in temperatures slated to reach 80 degrees. But he was ultimately confirmed by the Senate, 50-48.


Each federal court has a so-called "judicial council" to investigate conduct complaints and make disciplinary recommendations.

The judiciary's rules allow members of the public to lodge complaints about federal judges.

This means that the complaints made against him are effectively confidential and can be dismissed without releasing the details of the complaints to the public.

The public nature of a case previous year involving former 9th Circuit judge Alex Kozinski, who was accused of sexual misconduct, was unusual.
